The Rio Court denied the requests to reject the complaint and summary acquittal of the two military police who approached a group of teenagers in Ipanema, in the South Zone of the city, including three black sons of diplomats. Sergeants Luiz Felipe dos Santos Gomes and Sergio Regattieri Fernandes Marinho were charged with illegal retention and threat.
In the decision, Judge Guilherme Schilling, of the Military Justice Audit, denied the request and stated that, in theory, the facts narrated in the complaint constitute a crime.
The Civil Police even investigated the crime of racism, but the case was closed in August. At the time of the approach, police said the teens said there were no racially charged words or discrimination on the part of the officers.
The case was referred, in the Public Ministry, to the Military Justice Audit, which investigates the conduct of the police officers.
