During the past two days, US President Donald Trump has gone away again in testing the maximum limits for the possibility of exploiting his executive powers, which he has always repeated last year that he wanted completely and without competitors. Even if his speech, since Sunday evening, his intention to turn against an amnesty decisions issued by his predecessor Joe Biden, is just a completely empty gossip as these decisions, but the issue of the issue proves his intention to complete his coup and try to take revenge on all the symbols of investigations that followed him for the past four years, after the Democrats had the euphoria that removed it from the scene, which seemed false. Trump sparked the controversy again, the day before yesterday, by announcing that Biden’s amnesty decisions granted the latter to a number of “invalid” government officials and officials, claiming that without providing evidence that the former president signed the amnesty decisions by “Autopen”, an automatic device equipped with a pen, which re -produces a signature for someone who was previously recorded.
Biden pardon
Biden, hours before the authority was delivered to his successor on January 20, had granted amnesty to a number of officials and employees to protect them from “unjustified and political prosecution prosecutions”, and before that, last December, he granted amnesty to his son Hunter, who was a judicial prosecution of criminal charges, including tax evasion. Biden’s amnesty later walked to Trump, when in January hundreds of convicts pardoned the events of his supporters, the Congress headquarters on January 6, 2021, to impose not then bent at Biden’s victory in the presidency. Upon signing the amnesty, and on other executive decisions, Trump had deliberately appeared in his oval office, and he was signed by the pen. Last Friday, he stressed from within the Ministry of Justice that he signs his decisions himself, adding that “you cannot use an automatic pen, it is the rule,” which means perhaps a prelude to announcing his coup against Biden’s amnesty decisions, and perhaps going in this debate to the courts or the Supreme Court.
Biden granted the amnesty with the conclusion of his mandate to the former head of the Joint Chief of Staff, General Mark Miley, the doctor who coordinated the American administration’s strategy in combating Corona, Anthony Vochi, and deputies who participated in the Congress Investigation Committee related to the storming of the Capitol. This committee consisted of nine deputies, which was formed in July 2021, and then the council president, Nancy Pelosi, chose its members, seven Democrats, and two Republican deputies, Adam Kissinger and Lez Cheney, headed by Democrat Benny Thompson. The Republicans had obstructed in the Senate that year the formation of a “national committee” to investigate the storming, similar to the September 11, 2001 investigation committee. Lez Cheney, the hatred of Trump, had lost the midterm elections to renew its seat in 2022 in Wyoming state, in favor of a candidate for its support of Trump. Adam Kissinger, the other Republican in the committee that replaced itself in January 2023, did not run in the last midterm elections.
Trump wrote to “Truth Sushial” that the decisions of amnesty “that Joe Biden gave the sleeper of the unintended committee of political thugs and many others, according to this text is void and null and without any influence”, because it signed a “automatic pen”. It is not immediately clear whether Biden has already used an automatic pen to sign these decisions. Trump also posted the day before yesterday, saying, “It seems that there was an automatic pen for the president … Did he knew what he was doing? Did he authorize him?”, Accusing Biden that he did not know about the signature of the amnesty decisions related to the members of the investigation committee to investigate, indicating that there were those who signed it on behalf of the former president, but without his knowledge, in reference to the members of the committee who said that they were “subject to the highest levels.” Trump had criticized the day of his installation orders granted to people “very guilty of very serious crimes”, without calling them.
Trump suggested that Biden did not even knew of the amnesty decisions
Precedent
Trump alone does not have, according to the American constitution, the power to nullify Biden pardon decisions or amnesty decisions issued by any president of his predecessors, and no American president, over the history of the United States, has made a decision to cancel a presidential pardon that was already implemented. Trump or the White House, until Tuesday afternoon, did not announce practical steps to cancel the targeted Biden pardon, despite the controversy raised by the issue. When a journalist, a journalist, Caroline Levitt, asked on Monday if Trump has evidence that Biden did not sign or did not know the signature, she replied, “You are the journalist, and you have to know.”
According to Trump, Biden did not sign the pardon decisions related to the committee members, and therefore the public prosecutors have the right to pursue them, and the president believes, according to his claim, that Biden used the electronic signature tool to sign some amnesty decisions, and that the documents for this reason are not valid, and that Biden may not have been aware of each other, because of his suffering from my mental deterioration, according to Trump’s claim.
No American president made a decision to cancel a presidential pardon made by his predecessor
Trump, who has always vowed the investigating committee members of the events of storming the Capitol, is trying to prosecute, to remove all the obstacles that stand in the face of his revenge from them, and according to the “Axios” website, then he again tests the maximum boundaries to benefit from his executive powers, and to what extent he can go, without confronting a meaningful or able to stand in the face of his goals. The possibility of a coup on Biden’s amnesty decisions means that any president can withdraw from the reluctance of an amnesty for another former president, and the American “Mashabul” website confirmed that the presidential amnesty decisions in the United States do not need to sign up, and it can even be oral. A US court had ruled last year that while a written amnesty document is considered evidence of amnesty, the American constitution does not have to be written, which also means signed. While Biden stated the pardon, this is evidence that he knows about it, and not anyone else who signed it on his behalf. According to the site, the use of an automatic pen does not make the signature empty. Former President Barack Obama was the first American president to use the automatic pen to sign a draft law and make it effective (2011), although the presidents before him used it in correspondence or to sign documents.
In addition, Republican Representative Adam Kissinger responded to Trump, who vowed to nullify an amnesty issued by his predecessor Biden. The latter wrote on “X”, the day before yesterday, Monday, about Trump: “He is obsessed with me and former Deputy Liz Ceny more than his obsession with the points he collects from the terrifying golf game he plays.” He added: “Trump, complete threats, you are the weak and grumbling man.” Representative Adam Shif also wrote the target: “Your threats will not frighten us.”
