After the imprisonment of former football player Ibrahim Saeed due to the alimony ruling for his divorce, a question raises a question about the extent of the wife’s right to prevent her at the time of traveling in the event of his failure to pay the prescribed alimony by a judicial ruling, especially after she obtained a ruling on imprisonment for the alimony, and explains “the seventh day” in this report the position of the law on this matter.
The law gives the wife the right to obtain an order to prevent the husband or the ex -wife from traveling in the event that it is not paid any debt of the alimony sentence, after the ruling of his imprisonment.
Article (3) of Law 10 of 2004 regarding the establishment of the Family Court provides for its jurisdiction in the consideration of all issues of personal status, including issuing orders on a petition in the matters stipulated in the first article of Law 1 of 2000, which includes disputes about traveling abroad after hearing the statements of the stakeholders.
Also, submitting a ban from traveling does not require complex procedures, as it is not required to submit a settlement request, but it is sufficient to submit an official request attached to documents proving the issuance of the sentence of imprisonment with the unpaid alimony, while emphasizing hearing the statements of the parties concerned.
In the event that the other party does not attend, the judge can issue his decision in his absence.
Ibrahim Saeed, the former football player, filed an opposition to his imprisonment in a court ruling issued in favor of his ex -wife because of his extent, after he was arrested as a result of his failure to implement the court’s ruling, after the necessary legal measures were taken towards the incident and arrested him.
The divorced woman Ibrahim Saeed stated in the lawsuits that she filed, that the former player refrains from paying the necessary expenses, which prompted her to pay them from her own money after she informed the complainant against him in all legal methods to pay the amounts, according to the settlement requests, and then the player refrained from attending after announcing his law, and paying the amounts, despite the left of his condition, which prompted the settlement office to refer the lawsuit to the court.
The detectives arrested the former player Ibrahim Saeed, and he edited a report of the incident, against a background in implementation of a final ruling issued by the family court in Cairo, by obligating him to pay the expense of his son after pursuing him at the hands of his former ex -wife.
